Agreement
These terms are an agreement between you and the provider of the Luna app (“Luna”, “we”, “us”). They cover the Luna app and this website. Please also read our privacy policy. If you do not agree, please do not use Luna.
Using Luna
- Luna is meant to be used by parents and caregivers, including with children. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
- Purchases and account-level actions are for adults. Some actions are behind a parent check.
- We grant you a personal, non-exclusive, non-transferable, revocable licence to use Luna on devices you own or control, for personal and non-commercial use, under these terms and the rules of the store you downloaded it from.
- Teachers may read Luna stories aloud to their class as part of teaching. Please don’t record, project or redistribute the app’s content.
Luna Pro subscriptions
- Luna is free to download and includes some free stories. Luna Pro is an optional subscription that unlocks the full library and extra child profiles.
- Subscriptions are sold and billed by the App Store or Google Play. The price, billing period and any free trial are shown in the app before you confirm.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage and cancel them in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple or Google under their policies.
- You can restore an active subscription on another device that uses the same App Store or Google Play account, using “Restore” in the app.
- Which stories are free, and what Luna Pro includes, may change over time. We will not remove the core benefit of an active subscription during a period you have already paid for.
Stories and content
The stories, illustrations, characters, music, design and software in Luna belong to us or our licensors and are protected by copyright and other laws. Your licence lets you read the stories in the app. It does not let you copy, record, screenshot for redistribution, extract, sell, publish or create derivative works from them. The achievement card in the app is provided for you to keep, print or share personally.
The child’s name you enter is used only to personalise stories on your device, as described in the privacy policy.
Acceptable use
You agree not to:
- copy, modify, reverse engineer or attempt to extract the source code or content of the app, except where the law allows;
- bypass the subscription, the parent check or other protections;
- interfere with our servers or use automated means to access content;
- use Luna for any unlawful purpose.
Information on this website
Our articles summarise published research about reading with children and link to the original sources. They are general information, not medical, developmental or professional advice. If you have concerns about your child’s sleep, health or development, talk to a qualified professional.
Availability and changes
We work to keep Luna available and to add new stories, but we may change, add or remove features and content, and the app may sometimes be unavailable. Stories that are already on your device can be read offline. We may require an update to keep using the app. We may update these terms; if we make significant changes we will tell you in the app, and continuing to use Luna after that means you accept the updated terms.
Disclaimers
Luna is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data or profits, arising from your use of Luna. Our total liability for any claim relating to Luna is limited to the amount you paid for Luna Pro in the twelve months before the claim. These limits do not apply where the law does not allow them, for example for death or personal injury caused by negligence, or fraud.
App Store and Google Play
If you downloaded Luna from Apple’s App Store, you also agree that:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation;
- Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, or intellectual property claims;
- you are not located in a country subject to a US government embargo or on any US government list of restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you downloaded Luna from Google Play, Google Play’s terms of service also apply to your download and purchases.
Ending these terms
You can stop using Luna at any time by deleting the app (and cancelling any subscription in your store account). We may suspend or end your access if you seriously or repeatedly break these terms. Sections about content ownership, disclaimers and limitation of liability continue to apply after these terms end.
General
If any part of these terms is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. These terms are the whole agreement between you and us about Luna. These terms are governed by the laws that apply where we are established, without affecting the protection given to you by the mandatory laws of the country where you live.
